Vacation Rental Agreement (Tres Hermanas Roatan)

This vacation rental contract is a legal agreement between Tres Hermanas Roatan, (also referred to as the “Owner” and “Property Manager”) and you, the Renters (also referred to as “Guests”).
Property: The property is Tres Hermanas Owner’s Suite located upstairs and Tres Hermanas Beach Suite located downstairs (formerly known as Monkey LaLa Upper and Monkey LaLa Lower), located in West Bay Village, West Bay Roatan Isla de la Bahia’s, Honduras.
We, the Renters (also referred to as “Guests”), agree to the following:
1. Reservations and Payments: Payment of 50% of the rental price is due upon booking. The remaining balance is due 60 days prior to arrival. By accepting the reservation, both parties agree and enter into this rental contract and agreement.
2. Cancellation Policy: Cancellation 61 days or more before check-in, renters will receive a refund of the amounts paid, minus a credit card processing fee of 5%. Cancellation 60 days or less before check-in, Renters will forfeit the total rental. Renter may mitigate this loss by purchasing Travel Insurance or Cancel for Any Reason insurance from a third-party vendor. There are no refunds for early departure or inclement weather.
3. Airport Transfers: We are happy to arrange airport transfers upon request. Guest is responsible for notifying the Property Manager of arrival and departure times. Airport transfer may be set up for the guest by the Property Manager at a cost to the guest, unless otherwise arranged. The management is not responsible for missed flights, loss of luggage, or any occurrences that happen while in transport.
4. Prices: Shown are in U.S. Dollars and are subject to change without notice. Posted rates do not include 19% Honduran tax.
5. Credit Card Policy: It is Tres Hermanas policy that when a guest pays by credit card, the guest is required to show the credit card(s) used for payment, along with identification for the cardholder, at check-in.
6. Check-In & Check-Out: Check-in is after 3:00 PM, and checkout is before 10:00 AM. The Property Manager will meet you at the house upon check-in. PLEASE check out promptly, as there may be a short window to prepare the house for the next guests. Renters are responsible for returning keys to the designated place and left in the home.
7. Maximum Occupancy: Maximum occupancy for Tres Hermanas Owner’s Suite is 6 total guests, and for Tres Hermanas Beach Suite is 4 guests.
8. Subletting: The guest is not authorized to let or sublet all or any part of the premises, nor assign the lease or any interest in it.
9. Lost Keys: Any loss of keys will result in a $100 fee. Keys that are not turned in at check-out are also subject to a $100 fee, and the guest agrees to allow the Property Manager to charge their credit card for this. A $150 charge is applicable for lost safe keys.
10. Lock-Out Fee: Should you or one of your party lock yourself out and the Property Manager is called to open the door for you, a $50 lock-out fee will be applied outside office hours (Monday-Saturday 8:00 AM - 4:00 PM).
11. Air Conditioning: Air conditioning is included with rent. Electric rates on the island are approximately 4x US/Canadian electric rates, so please use responsibly.
12. Cleaning and Linen Policy: The guest agrees to keep the house, furniture and furnishings, and appliances in good order. Removing, adding, or changing furniture without the Owner’s written approval shall be deemed a material breach of the Rental Agreement, and is strictly prohibited. Guest is responsible for the cost of replacement or any damage to furniture or premises and replacement of missing items.
The home is provided with pillows, bed linens, bath and hand towels, kitchen towels, comforters, wash clothes, bath rugs, and beach towels. Full house cleaning prior to arrival, as well as mid-week cleaning, is included for weekly rentals. Linen service is available mid-week for weekly rentals or upon request. The home is provided with starter sets of toilet paper and paper towels and unlimited 5-gallon bottles of drinking water.
13. No Pets Allowed: No pet(s) are allowed on the property without prior written approval by the Owner. A pet or evidence of a pet will cause forfeiture of the entire rent, including the deposit, and immediate tenant eviction.
14. Condition of Property: Owners have, to the best of their ability, given an accurate description of the property and its condition. All electrical, plumbing, and appliances should be in working order. The failure of operation by certain amenities, such as TVs or Internet service, is not a basis for a refund. Owner will make every effort to have these items repaired, but does not guarantee that they will be repaired during the Guest's occupancy. The guest agrees to hold the Owner harmless from any liability for the condition of the house. Use at your own risk.
15. Island Occurrences: Island life is subject to occasional power and water failures and loss of internet or TV service. Our providers do their best, but please understand outages in these services may occur and are out of our control.
16. Natural Occurrences: Natural occurrences and weather are beyond our control. We do not provide refunds or rate adjustments in these cases.
17. Security: West Bay Village has 24-hour security; however, it is up to the guest to make sure the home is secure before leaving the home. Owner is not responsible for the loss of any items.
18. Construction: West Bay is a growing area and is becoming most desirable. There is the possibility that construction projects may be in progress nearby during the time of your stay. The Property Manager and Owner cannot predict when or where these jobs will begin or how long they will last. Therefore, we have no control over these situations, and no compensation or substitutions to other properties will be considered.
19. Assumption of Risk: The house does not offer lifeguards, and no lifeguard may be on duty. Accordingly, persons using the beach or dock do so at their own risk, and the owner assumes no responsibility for accident, injury, or loss. No one should swim alone, and children under 12 years of age are not allowed to swim without adult supervision.
Renters will hold the Owners harmless from all bodily injury and/or property damage incurred on the property arising out of Renters’ negligent acts or omissions.
20. Children on Property: Guests accept the risk of children on the property. These risks include but are not limited to access to the ocean, docks, and cleaning supplies that may be poisonous if ingested.
21. Personal Property: Guest understands that any personal property of the Guest is not insured by Owner, and Owner shall not be responsible for any lost, stolen, or missing property of the Guest, or property of the Guest left after checking out.
22. No Parties: Parties and gatherings of over 10 people are not allowed unless prior permission is given by the Owner. Special occasions such as weddings, receptions, parties, family reunions, or an increase of occupants (guests not indicated upon reservation) must be disclosed at the time the reservation is made and subject to Owner’s advanced approval. Adults cannot rent property on behalf of underage guests (under 25).
23. No Smoking, Drugs, or Illegal Substances: This is a Non-Smoking and drug-free vacation rental. Any evidence of smoking, such as smell, ash, or disposal of cigarettes, cigars, or marijuana inside the home, is sufficient basis to charge the renter for smoke cleanup of $500US, and the renter is liable for the deep cleaning costs incurred. Any evidence of non-prescription drugs or illegal substances, including marijuana, is grounds for immediate eviction, and this rental agreement will be terminated, and deposits will be retained.
24. Attorney Fee/Default: If any legal action is necessary, the Guest will be responsible for attorney fees and court fees.
25. Indemnification: Guest agrees to indemnify and hold harmless Owner for any liability arising before termination of this Rental Agreement for personal injuries or property damage caused by the negligent, willful, or intentional conduct of Guest(s). This indemnification agreement does not waive the Owner’s duty of care to prevent personal injury or property damage when that duty is imposed by law.
26. Disclaimer: Renters understand that the Homeowners are not responsible for any personal injury caused by slipping on wet pavement or surfaces, and that tenants are responsible for exercising care when surfaces are wet or slippery due to weather or the use of hoses and mops to wash down areas, and further, that the homeowners are not responsible for any personal injury or loss or damage to tenants’ property caused directly or indirectly from foul, inclement weather conditions, Acts of God or nature, fire, stoves, and ovens, or any unforeseeable circumstances.
Under no circumstances will Renters or their guests hold the Owner responsible for any damages or claims of any kind resulting from their stay, except for intentional acts of harm.
27. Accidental Damage: Renters will not be liable for damage or theft at the rental home up to $50, provided they alert their Property Manager promptly and prior to departure. Upon learning of the damage, a manager will visit the home to assess the damage and determine the amount for the repair/replacement. In cases where damage or theft exceeds $50, the guest will be responsible for the overage, and Owner reserves the right to charge the credit card on file for items, which include but are not limited to:
• Any damage not reported to the Property Manager
• Intentional damage to the property or its contents
• Theft without forced entry
• Damage caused when the maximum occupancy of a home, as stipulated on the reservation, is exceeded
• Unreported lost, stained, or damaged linens and towels
• A cleaning fee of $50 will be applied in cases where the home is not left clean
I have read this agreement and acknowledge responsibility for abiding by the contents and rules within by confirming a reservation with the Owner and/or Property Manager. I authorize Property Manager or Owner to charge my credit card for any, and all damage, missing items, cleaning fees, etc., described above that occur with the rental home.
